Yes, the audio is never stored, the summaries can be completely turned off, and yes, Apple again is caught inside its own bubble being ever more disconnected from the outside silicon valley life. They should not have touted this so strongly and loudly.
People will these devices are being kidnapped daily and forced to open their devices. Even without the audio some of these transcripts can be used as evidence against them or their families, violating their 5th amendment rights.

It’s a clever idea, although obviously many consumers are nervous about a proliferation of always-listening devices. The feature will be opt-in and obviously, Apple will tout its stringent privacy-preserving implementation compared to the competition. Apple’s version will not actually store audio recordings, nor will it present a transcript of conversations.
Let me tell you about apples “stringent” privacy. It means they will hesitate a second before giving the administration anything they ask.

I believe Apple Watch already ships with always on Siri, but I don’t know anyone who left that turned on.
Nothing changed in that regard. It doesn’t record audio, sound recognition runs on device. In the exact same way that all modern Apple devices (watches, phones, earbuds, …) can already listen for Hey Siri, and other brands listen for their wake words etc.
I think it will be functionally different than “recording”. When you talk to Siri or any other voice assistant, does it record your voice or simply transcribe it? This seems to be the latter.
And Apple has always made a point of saying things like this are on-device, not cloud
