Good God. I mean using AI for a brief is one thing, despicable enough, but using AI fabricated testimony should absolutely be grounds for disbarment. At minimum a count of contempt for every instance of fabricated testimony.

Also why should the defendant of the case have the case thrown out because of the attorney’s conduct?
Because they hired that attorney? They should have to start over and hire a different attorney. They can sue the original attorney if they didn’t know anything about the deception.

Rules about ai need to catch up. Until people in general are more familiar with hallucinations and lack if hehe I in AI, it wouldn’t be just to hold people more accountable for its failures beyond other tools. It should be treated the same, just as other misinformation and misleading statements have been in the past.
