I don’t believe they are saying the person isn’t mentally capable of wanting this person’s kids taken away. They are just saying they don’t believe they have enough to prove her intent was criminal. Aka the law needs to either be re-written to protect parents from absurd claims like this, or absurd claims like this will continue to be non-criminal offenses.
